Jack Connarton, a Litigation Partner in our Professional Practices Group at Donovan Hatem, reviewed the key components of effective preparation and conduct for a design professional liability trial.
Jack began with a brief overview of the importance of pre-trial discovery; in particular, various types of depositions, and the most effective use of depositions at the trial.
Next, Jack reviewed the pre-trial path of preparation, including:
- Document management
- Exhibit selection
- Witness selection and preparation
- Pre-trial motions to preclude expert testimony or other proposed evidence
- Preparation of expert witnesses
Jack then discussed what occurs when the trial begins, from jury selection (mysteriously known as voire dire) through closing arguments, as well as direct- and cross-examination techniques for design professionals.
