Eric Howard and Matthew Tuller of Donovan Hatem LLP focused this roundtable on the relationship between the Prime consultant and its subconsultants—including an overview of contract provisions to include in the Prime/subconsultant agreement regarding coordination of scope of services, budget, schedule and quality control. They provided a contract overview involving a discussion of payment provisions, dispute resolution, and ownership of documents. 

Additionally, Eric and Matt focused on the purpose, role and factors to consider before entering into a joint defense agreement—including a discussion of confidentiality, the joint defense privilege, sharing information, and tolling of limitations. They concluded the presentation by discussing the benefits of the joint defense agreement and claim scenarios.
