Recent amendments to the Federal Rules of Civil Procedure relating to electronic discovery went into effect in December of last year. With the ever- increasing volume of electronic documents in use today by all companies, compliance with these new rules could be time-consuming and expensive for your firm. This roundtable discussion, led by Donovan Hatem LLP partners Cheryl A. Waterhouse and Nancy M. Reimer, and featuring Kenneth V. Nourse of Kroll Ontrack, will explain what electronically-stored information (ESI) consists of, how courts have ruled on electronic discovery disputes in the past and what the new rules require in terms of managing, preserving and disclosing ESI. We will address what firms need to do to best prepare now for possible future litigation. We will discuss identifying and cataloguing what ESI you have, managing that ESI with document retention policies and a records retention manager and preserving or "holding" documents when you receive notice of a claim or litigation.
